The above offer form is a legal and binding document. Making an offer for the purchase of an alpaca is the same as making a commitment to purchase; should your offer be accepted by the seller.
    

 1. All purchases must be in U.S. dollars.
 2. Price.  Upon acceptance of an offer, a nonrefundable deposit is required.  It is the option of the purchaser if they wish to make payment in full at the time of offer acceptance.  If this is the option the purchaser selects they will be directed to a secure location to enter their credit card information.
3. Price - payments made in installments:  Upon acceptance of this offer a down payment is required. The balance of the amount due shall be paid in monthly installment payment with a flat rate of 6% for a period not to exceed one year unless otherwise specified by the seller. Payment must be made in full in U.S. Dollars prior to transfer of the ARI Certificate to the purchaser's name.
4. Transportation. It is the responsibility of the buyer to provide transportation of said animal at his or her own expense.
5. Agistment.  There will be no boarding/Agistment fees charged if the purchaser transports the alpaca within fourteen (14) days of the date of purchase.
6. Warranties: 
A:  Title. Seller warrants their title to the animal is free and clear. Seller agrees to transfer to Buyer said free and clear title at the time of payment in full. Seller agrees to indemnify and hold Buyers risk-free of any claim(s) made by third parties to the right of possession, encumbrances, liens, security interest or title of the animal.
B:  Implied Warranties. Buyer is aware and understands that said animal is sold "As Is." There are no other warranties implied, written, or expressed other than warranties laid out in this contract.
C:  Express Warranties. Seller warrants that the animal is not suffering from any adverse medical conditions to Seller's knowledge. Seller also warrants that the genealogy, as established on the animal's ARI Registration Certificate, is true and accurate to the best of Seller's knowledge. Seller also warrants that said animal is capable of reproduction and has normal reproductive anatomy unless otherwise animal is sold as a Pet Quality alpaca.
D. Warranty On Pregnant Female. Seller warrants the female alpaca only and does not extend any warranties to the unborn cria. Cria's health, show capabilities and reproduction qualities are in no way warranted by Seller.
E.  Other Warranties. No other warranties are made herein by Seller. Buyer shall not rely upon any statements, descriptions, or representations regarding this animal except as set forth within this contract.
7. Buyer's Option. Seller agrees to allow the buyer, at seller's expense, a full examination of said animal by a qualified veterinarian (a fully state licensed veterinarian). Buyer may choose the veterinarian. If Buyer chooses this option it must be done within seven (7) days of the purchase of said animal. If a qualified veterinarian determines any adverse medical conditions, Buyer must inform Seller within three (3) days of the veterinarian's examination and Buyer shall then be entitled to a full refund if they select the option to rescind this contract. This option is not assignable to any other parties should Buyer, as named in this contract, sell or transfer any interest in the animal to another party.
8. Transfer of Warranties. All warranties herein are non-transferable to any other individuals.
9. Disputes. Any disputes that may arise between the parties of this contract shall be under the jurisdiction of the state and judicial district of the Seller.
10. Attorney's Fees. In the event of any legal proceedings arising from this contract, the party who prevails shall be entitled to payment for court costs and reasonable attorney's fees as well as any relief granted by the court.
11. Timely Action. Legal proceedings shall be instituted with six months of the date of this contract. Buyer agrees to give Seller a reasonable opportunity to respond to any disputes allowing Seller the opportunity to offer a remedy of the alleged breach of contract if appropriate.
